California Notary & Real Estate Signing FAQs

Answers to common questions about mobile notarization and real estate signings in California—from identification to escrow deadlines.

Do I need a notary for…?

The answer depends on the document, California law, and the receiving organization’s requirements. Start here, then confirm your specific instructions.

Do I need a notary to buy a house in California?

A financed purchase typically includes notarized signatures on documents such as the deed of trust. Not every buyer document is notarized. Ask escrow for the complete signing requirements and approved assignment; notarization is only one part of completing the purchase.

Reference: CFPB: what happens at closing

Do I need a notary to sell a house or record a grant deed?

A grant deed presented for recording generally needs the signer’s acknowledgment; recording law has specific exceptions. Escrow should provide the deed and determine the recording requirements for your sale. We can arrange notarization of the prepared document.

Reference: California recording acknowledgment requirements

Do I need a notary for a quitclaim deed?

A quitclaim deed intended for recording generally needs the signer’s acknowledgment. Have a qualified preparer handle the deed and confirm county requirements. A notary does not determine whether quitclaim is the right transfer method or whether the transfer has tax consequences.

Reference: California recording acknowledgment requirements

Do I need a notary for a refinance?

A refinance package commonly contains documents requiring notarization, alongside pages needing only signatures or initials. Let your lender or escrow team identify the required acts and approve the signing agent. We can coordinate the prepared package and its return instructions.

Do I need a notary for a HELOC or reverse mortgage?

These packages can contain notarized documents. Ask the lender for its exact execution and disclosure instructions rather than treating a HELOC, reverse mortgage, and conventional mortgage as the same package. We offer signing appointments for prepared packages after confirming scope and timing.

Do I need a notary if I buy a home with cash?

A cash deal may still require notarized seller or transfer documents even though there is no mortgage loan. Ask escrow which signatures require notarization and which party needs an appointment. We can coordinate the prepared cash-purchase or seller package.

Do I need a notary for a California power of attorney?

California’s general power-of-attorney execution rule permits acknowledgment before a notary or signing by two qualifying witnesses, along with other required elements. Real-estate recording and lender acceptance may add requirements. Have your attorney and receiving party confirm the correct execution plan.

Reference: California power-of-attorney execution rules

Do I need a notary for a will in California?

A typical California witnessed will uses two qualifying witnesses; a notary stamp does not replace the required execution process. Other will types and exceptions exist. Have an estate attorney identify what your document requires before booking. Do not assume notarization alone makes a will valid.

Reference: California witnessed-will requirements

Do I need a notary for a living trust or trust transfer?

Have your estate attorney identify which prepared documents need notarization. A trust agreement, certification of trust, and deed transferring property are different documents. We can arrange the requested notarizations, but cannot determine whether your trust is properly created or your property has been transferred.

Do I need a notary for an advance healthcare directive?

A written California advance healthcare directive generally permits either acknowledgment before a notary or two qualifying witnesses, with other execution conditions. Special rules can apply to patients in skilled nursing facilities. Ask the preparer or facility to confirm the required witnesses before the visit.

Reference: California advance healthcare directive rules

Do I need a notary for an affidavit or sworn statement?

A sworn affidavit commonly calls for a jurat: an oath or affirmation and signing before the notary. Some receiving organizations instead accept a declaration that does not require notarization. Ask the issuer for its required form and act; we cannot choose them.

Reference: California jurat requirements

Do I need a notarized letter for a child traveling with one parent or another adult?

Some destination countries require notarized parental permission or custody documentation. Check the destination’s entry and exit rules and your airline’s instructions before travel. Bring the prepared consent letter and required parent or guardian signers; notarization does not resolve a custody dispute.

Reference: U.S. Department of State: travel with minors

Do I need a notary for a California vehicle bill of sale?

California DMV says a bill of sale is not required to be notarized or witnessed. Other vehicle forms, lienholder releases, or another state’s requirements can differ. Identify the exact form and receiving agency before paying for a notarization you may not need.

Real estate & loan signing appointments

Practical answers for buyers, sellers, borrowers, escrow officers, and signing services.

What does a notary signing agent do at a real estate closing?

A signing agent coordinates execution of the prepared package, identifies signers, and completes required notarizations. We point out signature and initial locations and contact the assigning company when issues arise. Loan terms, legal effects, and decisions about whether to proceed belong with your lender, escrow officer, or attorney.

Reference: NNA: the signing agent’s role

What types of real estate signing packages can you handle?

Mortgages, refinances, reverse mortgages, HELOCs, and seller/cash-purchase packages. Tell us the transaction type, number of signers, appointment location, and deadline. Printing, scanbacks, document return, and the total signing fee are confirmed for the assignment before acceptance.

Can I hire my own mobile notary for a home purchase or refinance?

Ask your escrow officer, lender, or signing service before booking independently. They need to approve the assignment and provide the current package and instructions. A separate notarization appointment does not replace their complete closing process. We can coordinate with your transaction contact once authorized.

Can you take a same-day or next-day loan signing?

Call (510) 301-6733 with the requested time, signing city, transaction type, and document-ready deadline. Same-day assignments depend on availability, travel, and receipt of instructions. We confirm acceptance directly; submitting a form alone does not secure a closing deadline.

How long should I allow for a loan signing appointment?

Plan roughly 45–90 minutes for a full loan package as a scheduling estimate, with extra time for large packages, multiple signers, accessibility needs, or lender questions. A short general notarization is different. Let us know the package size so we can reserve an appropriate visit.

What should I have ready for my real estate signing?

Have qualifying identification for every signer, the complete current package, and the lender or escrow contact’s phone number. Ask escrow whether it needs ID copies, supporting documents, or a particular payment method. Have a clear table and allow enough uninterrupted time. Do not send ID numbers or bank details through our public form.

Can I review the loan documents before the notary arrives?

Yes—ask your lender or closing agent for the package in advance. Review key terms and raise questions before the appointment. Check the note, security instrument, deed, and applicable disclosures; do not wait until the signing to resolve a disputed loan term.

Reference: CFPB: review closing documents

Does every page in a mortgage package need notarization?

No. A package includes documents with different execution requirements; some need signatures or initials without a notarial certificate. We follow the provided instructions and complete the required notarial acts. The document preparer determines the package contents.

Is signing my loan documents the same as closing escrow?

No. Signing is one part of the transaction. Funding, disbursement, recording, and final closing are handled by the lender and settlement team. Ask escrow for the actual closing status rather than treating the notary appointment as proof that the deal is complete.

Reference: CFPB: what happens at closing

Will I get my keys or sale proceeds immediately after signing?

Do not assume so. Your escrow officer or settlement agent must confirm when funds and closing requirements are satisfied and when possession or proceeds are released. We do not release keys, control disbursements, or promise a funding date.

Reference: CFPB: what happens at closing

Does an all-cash real estate purchase still involve a notary?

It can. A cash purchase has no mortgage loan package, but escrow may still require notarized transaction documents. Ask escrow which parties must sign and which documents need notarization. We can arrange the prepared seller or cash-purchase signing package without deciding the transaction’s document requirements.

What should sellers confirm before their signing appointment?

Confirm with escrow which owners or representatives must sign, how their names appear, and whether any trust, entity, or power-of-attorney instructions apply. Provide the package and return deadline. Questions about payoff amounts, seller proceeds, liens, or transfer taxes go to escrow or the appropriate adviser.

Mortgage documents, disclosures & timing

Know what to ask before the signing—not just where to sign.

What is the difference between a promissory note and a deed of trust?

The promissory note sets out your repayment promise. A deed of trust is a security instrument tied to the property securing the loan. Ask your lender or attorney about the specific obligations in your documents; the signing agent does not interpret their legal effect.

Reference: CFPB: mortgage closing documents

Is a grant deed the same thing as a deed of trust?

No. A transfer deed and a loan security instrument serve different purposes. If you are unsure which deed you need or how ownership should be held, have your escrow officer or real estate attorney resolve that before the visit. We notarize prepared documents rather than select or draft deeds.

Reference: CFPB: review closing documents

What is a Closing Disclosure, and when should I receive it?

For covered mortgage transactions, the Closing Disclosure lists final loan terms, projected payments, and closing costs. You must receive it at least three business days before closing. Compare it with your Loan Estimate and ask your lender about differences.

Reference: CFPB: Closing Disclosure

Do HELOCs and reverse mortgages use the same Closing Disclosure?

No. The CFPB identifies different disclosure forms for these products: HELOCs use Truth-in-Lending disclosures; reverse mortgages use a HUD-1 and final Truth-in-Lending disclosure rather than the standard Closing Disclosure. Ask the lender which forms apply to your loan.

Reference: CFPB: Closing Disclosure

What if the interest rate, payment, or closing costs look wrong?

Pause and contact your lender or escrow officer. We can help locate the relevant printed figure, but cannot justify a changed rate, calculate disputed fees, or tell you the loan is a good deal. Have the responsible professional resolve the discrepancy before deciding whether to sign.

Reference: NNA: borrower questions at signing

Can a same-day notary appointment bypass a mortgage disclosure waiting period?

No. Booking a signing does not override applicable lender disclosure requirements. Ask the lender whether the transaction is eligible to proceed and whether any corrected disclosures affect the scheduled date. We cannot approve a waiver or decide the lender’s compliance obligations.

Reference: CFPB: Closing Disclosure

Do I have three days to cancel a refinance or home-equity loan?

Certain loans secured by your principal residence have a federal right of rescission; not every transaction qualifies. Review the notice supplied by your lender and confirm applicability. A purchase mortgage generally does not have this same right. Do not rely on a general FAQ as your transaction’s cancellation instructions.

Reference: CFPB: right-of-rescission timing

Do weekends count in the three-day right-of-rescission period?

For the federal rescission period described by the CFPB, Saturdays count; Sundays and legal public holidays do not. The clock starts only after the required signing and disclosures have occurred. Confirm the specific deadline and notice-delivery instructions with your lender.

Reference: CFPB: right-of-rescission timing

Can I cancel my loan by telling the notary?

Do not rely on telling us as notice to your lender. Follow the written notice and delivery instructions for your transaction, retain a copy and delivery evidence, and contact your lender or attorney promptly. Cancelling an appointment is separate from exercising a legal right to cancel a loan.

Reference: CFPB: right-of-rescission timing

Can the signing agent tell me whether a reverse mortgage is right for me?

No. Discuss suitability, repayment triggers, costs, and ongoing property obligations with your lender and an appropriate housing counselor or adviser. Our role is the prepared signing appointment, not mortgage counseling. Reverse-mortgage responsibilities can continue after signing.

Reference: CFPB: reverse mortgages

Can you tell me when my first mortgage payment is due?

We can help you locate the printed payment information in your package. Ask your lender or servicer to confirm the due date, payment destination, and any conflicting instructions. We do not establish payment terms or change a loan servicing arrangement.

Reference: NNA: the signing agent’s role

Deeds, trusts, powers of attorney & multiple signers

Resolve signing authority and document questions before the appointment.

Can you notarize a quitclaim deed or grant deed?

We can arrange notarization of a prepared deed when the signing requirements are met. Have your attorney, title company, or document preparer address ownership, legal descriptions, and deed wording first. Notarization does not guarantee that a deed is legally effective or recordable.

Can you help me choose joint tenancy, community property, or trust vesting?

No. Those choices can affect ownership, inheritance, taxes, and liability. Ask a licensed attorney or qualified transaction adviser. Give us the final prepared documents after those decisions have been made. We cannot select vesting language or suggest a deed type.

Reference: CFPB: review closing documents

What if I am signing as a trustee or for an LLC or corporation?

Tell the assigning company before the appointment. Have it approve the signer, signature format, and any supporting authority documents it requires. Bring your individual ID. We cannot decide whether your trust, resolution, or entity documents authorize the transaction.

Can someone sign real estate documents using a power of attorney?

Potentially, but obtain advance approval from the lender and title/escrow team. They must determine whether the power of attorney is acceptable and give execution instructions. The attending signer needs qualifying identification. Do not book assuming that any power of attorney will be accepted.

Can you create a power of attorney so someone else can sign my closing?

No. Ask an attorney or the appropriate document preparer to prepare it, and have the transaction team approve it. Creating and notarizing a power of attorney may be a separate appointment from using it in the closing package. Allow time to resolve both sets of requirements.

Does my spouse need to attend if they are not on the loan?

Ask the lender and escrow officer to identify every required signer. A person who is not a borrower may still appear on transaction documents, depending on the package. We do not determine marital property rights or decide who must execute a deed. Confirm attendance before booking.

Can buyers or co-borrowers sign in different locations or at different times?

A split signing may be possible with the assigning company’s approval. It must coordinate package order, notarial certificates, delivery, and deadlines. Each notary completes acts only for the signer appearing before them. Tell escrow about the split arrangement before scheduling.

Reference: NNA: split signings

Can I bring my partner’s signed documents if they cannot attend?

For the acknowledgments and jurats we perform, each person whose signature is being notarized must appear personally. A signature on paper does not replace that appearance. Ask escrow about an approved split signing or rescheduling.

Can you notarize documents in California for property in another state?

Call with the package and receiving party’s instructions. The notarization we perform in California must meet California requirements; the recipient must confirm its document, recording, and transaction requirements. We do not guarantee acceptance in another jurisdiction or travel outside our agreed service area.

Identification, signatures & notarial certificates

Avoid the preventable issues that can interrupt a signing.

What ID can I use for a California notarization?

Common qualifying IDs include a California driver’s license or ID card and a U.S. passport. Other statutory categories have additional requirements. Bring the original and tell us the issuing agency and issue/expiration dates beforehand if there is any doubt.

Reference: California identification rules

Can a California notary accept an expired ID?

Some qualifying identification can be used if current or issued within five years. An expired card is not automatically acceptable; its category and issue date matter. Lenders may impose additional identification requirements. Call before the visit.

Reference: California identification rules

Can I use a photo, photocopy, or digital image of my ID?

Bring the original qualifying identification document. A phone photo or ordinary photocopy is not a substitute for the identification required for our appointment. Ask in advance if you cannot present the original.

Reference: California identification rules

Can I use credible witnesses if I do not have qualifying ID?

California permits credible-witness identification in specific circumstances, with required oaths and eligibility conditions. It is not a shortcut for forgetting an available ID. Call first; witnesses and lender acceptance must be reviewed before scheduling.

Reference: California identification rules

What if my ID and closing documents show different names?

Tell us and the assigning company before the appointment. Do not assume a nickname, omitted surname, married name, or spelling difference can be ignored. The notary must satisfactorily identify the signer, and the document preparer must resolve document-name issues.

Reference: California identification rules

What is the difference between an acknowledgment and a jurat?

An acknowledgment concerns the signer’s acknowledgment of executing the document. A jurat requires an oath or affirmation and signing in the notary’s presence. Both involve identification and personal appearance. Ask the document issuer which act is required; we cannot choose for you.

Reference: California jurat requirements

Can you notarize a document I already signed?

An acknowledgment may concern a signature made earlier, but you must still appear and acknowledge it. A jurat requires signing in the notary’s presence. Tell us if a document is already signed so the act can be handled correctly.

Reference: California acknowledgment certificate requirements

Can you notarize a deed or affidavit with blank information?

We cannot notarize a document known to be incomplete. Have its preparer complete missing substantive information before the visit. Leave notarial certificate fields for the notary; do not fill them with guessed dates or venue information.

Reference: California Notary Public Handbook

Can you date the notarization for an earlier closing date?

No. The notarial certificate must reflect the actual notarial act. A transaction deadline or an earlier date printed on a document does not permit backdating. If the package has a date problem, contact the assigning company before proceeding.

Reference: California Notary Public Handbook

Why do I need to leave a thumbprint for a deed or power of attorney?

California requires a journal thumbprint for specified real-property documents and powers of attorney, with statutory exceptions. The notary records permitted alternatives or a physical inability to provide a print when applicable. This is a journal requirement, not a request to upload fingerprints online.

Reference: California notary journal rules

Will the notary keep my entire loan package?

A notarial journal records required information about the acts; it is not an archive of your whole loan. Package handling and return follow the assignment instructions. Do not send confidential loan documents through the public appointment form. Ask the assigning company for its approved delivery channel.

Reference: California notary journal rules

Are document witnesses the same as credible identification witnesses?

No. A witness to execution and a credible witness used to establish identity perform different functions. Have your document preparer identify any execution-witness requirements. Witnesses are not automatically included in our appointment; arrange them before the visit.

Can we do the California notarization over Zoom or FaceTime?

Our appointments are in person. The California Secretary of State currently says a video image does not satisfy personal appearance for California acknowledgments and jurats. Remote-notarization implementation is changing; check the Secretary of State’s current guidance rather than assuming SB 696 already allows a video visit.

Corrections, recording, funding & closing security

What to do when a deadline is close or the package needs attention.

What if the package contains the wrong address, names, or loan amount?

Stop and call the lender or assigning company. It must decide whether to correct or redraw the documents. We do not revise legal descriptions, rewrite loan terms, or improvise a fix to meet a deadline. Arrange a new time if corrected documents are not ready.

Should I sign in blue ink, initial every page, or sign my full printed name?

Follow the assigning company’s approved instructions; requirements vary by package. Do not pre-sign or add initials to unmarked pages merely to be safe. Raise signature-format questions, especially representative-capacity signatures, before signing. We can contact the assigning company for direction.

Can you print a corrected package or provide scanbacks?

Discuss printing, scanbacks, secure delivery, and courier deadlines before we accept the assignment. These services and any additional visit are quoted for the actual scope. A redraw after the appointment is scheduled may change timing; call rather than assuming the original deadline still works.

Can a completed notarial certificate simply be corrected later?

California’s handbook directs a new notarization when an error in a completed notarial act is discovered. That means a new appearance, certificate date, and journal entry. Contact us promptly to coordinate the appropriate next step with the receiving party.

Reference: California Notary Public Handbook

Does notarization guarantee the county recorder will accept my deed?

No. Recording is a separate step with document and submission requirements. Have escrow or your document preparer check the receiving county’s requirements. A notary does not approve the deed’s contents, legal description, ownership effect, or recording eligibility.

Who records the deed and deed of trust after a real estate signing?

In an escrow closing, the settlement team coordinates submission for recording. Confirm your specific arrangement with escrow, including who receives originals and who tracks recording. Booking a notary alone does not include recording or create an escrow service.

Can a notary guarantee same-day funding or recording?

No. We can confirm the signing appointment and agreed document-return plan. The lender, escrow team, and recorder control the remaining steps. Ask those parties about cutoffs, outstanding conditions, and the actual transaction timeline before arranging movers or relying on sale proceeds.

What should I do if I receive new wiring instructions before closing?

Verify instructions directly with your trusted escrow or settlement contact using a previously verified number—not a number supplied in the new message. Do not rely on an email’s appearance or urgency. We do not issue or change wire instructions.

Reference: CFPB: protect closing funds

What if I think I wired closing funds to a scammer?

Contact your bank or wire-transfer provider immediately and request a recall. Notify your verified settlement contact and report the incident to the FBI’s Internet Crime Complaint Center. Fast action matters; do not wait for the notary appointment to address it.

Reference: CFPB: protect closing funds

Who pays the loan signing fee, and is it the same as the notarial fee?

Confirm the responsible payer with the assigning company. A package quote can cover coordination, travel, printing, and returns; notarial fees are itemized separately from those services. Do not assume a direct booking will be paid through escrow without its approval. See our Pricing page for starting package rates.

Mobile notary availability, prices & everyday visits

How to arrange your appointment or reach us when the calendar does not show the time you need.

How do I find a mobile notary near me in the North Bay?

Share the complete signing address and preferred time. Knock Knock Notary serves Sonoma County by appointment, with Marin and Napa visits by arrangement. Use our Service area address checker, then request a visit or call (510) 301-6733. County coverage does not guarantee a particular slot.

What are your regular notary appointment hours?

Regular appointment availability is 7am–1pm and 5:30pm–10pm Pacific, seven days a week, subject to existing appointments and travel. Loan signings can change day-to-day availability. Check the calendar when enabled or call for a confirmed time; these hours do not mean walk-in service.

Can I call if the calendar does not show the appointment time I need?

Yes. Call (510) 301-6733 or submit a visit request with your deadline and location. We may be able to arrange another time, depending on travel and existing commitments. No extra time is guaranteed until we personally confirm it.

Does choosing a time online immediately confirm my appointment?

No. Calendar bookings require approval, and form submissions are requests. We review travel, documents, and your quote before confirming. Watch for the confirmation and contact us if your deadline is approaching. For calendar bookings, use the scheduling service’s cancellation or rescheduling link.

How much does a California notary charge?

California caps an acknowledgment at $15 per signature and an oath/affirmation with jurat at $15 per person. Statutory exceptions apply. Our travel and any agreed package services are quoted separately. Ask for the total before confirming; a document can involve multiple notarial acts.

Reference: California notarial fee limits

How is the mobile notary travel fee calculated?

We quote travel for the signing address, timing, and appointment scope. It is separate from the notarial fee. Tell us about access restrictions, multiple stops, or urgent timing before confirming so the quote reflects the actual visit. There is no automatic mileage charge collected by this website.

Can you visit a hospital, care facility, office, or home?

Yes, by arrangement and subject to access and the signer meeting notarization requirements. Share the facility, visiting restrictions, and a suitable time. Family members cannot substitute their own signatures or consent for the required signer. Confirm any witness arrangements with the document preparer.

Do you have walk-in or on-site notary appointments?

Appointments must be arranged in advance. Call to confirm whether an on-site meeting location is available, or request a mobile visit to an agreed address. A booking option is not an invitation to arrive unannounced at a private location.

Can you prepare legal documents or tell me which notarization I need?

No. Have your document issuer or attorney prepare the document and identify the required notarial act. We can discuss appointment logistics and what to bring, but cannot choose legal forms or advise on their effects.

How do I change or cancel a notary appointment?

Call (510) 301-6733 or email info@knockknocknotary.com as soon as possible. For a calendar booking, also use its cancellation/rescheduling link. Review our Terms for any previously agreed travel charges. We do not impose an automatic cancellation penalty simply because a form was submitted.

What information should I include in the appointment request?

Include your contact details, service type, full signing address, preferred time, number of signers, and any deadline or access instructions. Leave out Social Security numbers, bank information, ID numbers, and confidential document contents. We will coordinate any needed document delivery separately.
